GARLAND (CBSDFW.COM/AP) — A registered sex offender from Garland has been sentenced to 15 years in prison for possessing hundreds of child pornography images.

Erick Fernando Duarte, 59, pleaded guilty to one count of possession of child pornography back in August. He has been in federal custody since May.

Court documents say Garland police executed a search warrant of Duarte’s home after receiving a tip from the National Center for Missing and Exploited Children that child pornography had been uploaded to his AOL account.

A review of his cell phone and other media revealed more than 1,200 images of child pornography, including images of prepubescent children involved in sex acts.

This isn’t Duarte’s first brush with the law. Back in October of 1995 he was convicted for the felony sexual assault of a 14-year-old.

NORTH TEXAS (CBSDFW.COM) – A 76-year-old Mesquite man has been sentenced to 240 months in federal prison, after pleading guilty to one count of receipt of child pornography.

Robert Bruce Lloyd admitted that he had collected child pornography for 30 years.

It was in January of last year when the FBI learned a specific IP address, later identified as Lloyd’s, was downloading and sharing files that were believed to contain child pornography. After special agents searched Lloyd’s home, officials found more than 1000 images and videos of child pornography on his computer and other media devices.

After the search warrant discovery, Lloyd admitted that he had received and was in possession of images that included bondage and sadistic acts involving minors. During his sentencing hearing, U.S. District Judge Sidney A. Fitzwater said the pictures were some of the worst he had ever seen.

The case was investigated and prosecuted as part of Project Safe Childhood, a nationwide initiative launched in May 2006 by the Department of Justice, to combat what official’s call “the growing epidemic of child sexual exploitation and abuse.”

INDIANAPOLIS (AP) — A federal appeals court in Chicago has set a May hearing for former Subway pitchman Jared Fogle’s appeal of his more than 15-year sentence in a child sex abuse and pornography case.

Fogle’s attorneys and federal prosecutors will go before the 7th U.S. Circuit Court of Appeals May 20 to present their arguments for and against the Indiana man’s bid for a shorter sentence.

Fogle was sentenced in November to 188 months in prison after pleading guilty to one count each of distributing and receiving child pornography and traveling out of state to engage in illicit sexual conduct with a minor.

His attorneys say a federal judge abused her authority by giving Fogle a sentence three years longer than the maximum prosecutors had sought.

Prosecutors say the judge acted properly.

MANSFIELD (CBSDFW.COM) – A 62-year-old man who once was a special needs teacher in the Mansfield Independent School District will spend the next 60 years in federal prison for producing child pornography.

A district judge handed down the sentence to Kelly Dan Williams Jr. after he admitted sexually exploiting children. He pled guilty to two counts of Sexual Exploitation of a Child back in January.

Williams was indicted after someone at Mary Orr Intermediate School saw him performing a sex act on an 11-year-old male student and reported it. The incident took place in the school bathroom.

The Mansfield Police Department began their investigation and when they searched Williams’ home seized several electronic storage devices.  When forensic investigators looked at those devices they found video of Williams performing a sex act on a minor male — again in what appeared to be a school bathroom.

When Williams plead guilty he admitted to having sexual contact with a minor boy and recording several different incidents on video.

Williams 360 month prison sentence, for each count, will run consecutively.

FORT WORTH (CBSDFW.COM) –  A 59-year-old teacher at Reinhardt Elementary School in Dallas ISD was arrested and charged with receipt of child pornography.

Mark Stutheit remains in federal custody after a probable cause and detention hearing Wednesday morning in federal court in Fort Worth.

According to the complaint and testimony at the hearing, the investigation began in May when an undercover officer with the Queensland Police Service (Brisbane, Queensland, Australia) and a person later identified as Stutheit exchanged emails about the sexual exploitation of children, according to the U.S. Attorney’s Office in the Northern District of Texas.

On June 23, special agents with U.S. Immigration and Customs Enforcement’s Homeland Security Investigations executed a search warrant at Stutheit’s home in Saginaw.

Investigators say they found “numerous files” containing child pornography on Stutheit’s computer and mobile devices.

If convicted Stutheit faces up to five to 20 years in federal prison.

When CBS11 contacted DISD for comment a spokesman said via email:

“”Today, Dallas ISD learned that a teacher at Reinhardt Elementary School has been charged in a federal child pornography case. The safety of our students is vital, and we will support law enforcement and take the appropriate steps to keep our students safe.”

FORT WORTH (CBS11) – New court documents reveal more about the former teacher charged with receiving child pornography.

A federal investigator says former Fort Worth ISD drama teacher and church youth minister Matthew Keller told him he met a Michigan boy about two years ago on a website.

The investigator says Keller also told him the boy originally said he was 18-years-old, but a month later admitted he was only 13.

According to the affidavit Keller stated he considered the boy to be his boyfriend and described their communications and conversations as sexual in nature.

Keller allegedly told authorities the victim sent him approximately 25 nude photos and 25 nude videos.

The parents of the boy in Michigan uncovered the communication and discovered Keller planned to fly to Michigan to possibly meet the boy for sex.

Investigators also say Keller had entertained thoughts of making sexual advances on three boys in this area but apparently never acted on the impulse. The judge today ordered Keller remain in jail.

The church where he volunteered, Haltom Road Baptist Church in Haltom City, released a statement saying they don’t think any of their children were targeted by Keller.

Fogle Says Child Porn Victim’s Parents Are To Blame

INDIANAPOLIS (AP) – Subway’s former pitchman imprisoned for child pornography and sex abuse argued in a Thursday court filing that the parents of one of his female victims are to blame for what he describes as her “destructive behaviors.”

Jared Fogle’s motion filed in U.S. District Court in Indianapolis also argues that the parents may be responsible for the girl’s injuries alleged in a civil lawsuit against him.

The victim was a subject in some of the child pornography in Fogle’s criminal case and filed a lawsuit against him in March. It seeks monetary damages for, among other things, personal injury and emotional distress.

Fogle’s filing alleges the parents fought and abused alcohol in front of her. It argues that’s among the causes of her distress and contends the parents may be liable for some or all of her claims against Fogle.

Fogle was sentenced in November to more than 15 years in prison after pleading guilty to distributing and receiving child pornography and traveling out of state to engage in illicit sexual conduct with a minor. Fogle has paid restitution to his victims, but they can still sue him and seek additional money.

The parents are not named in the court documents, and the victim is referred to only by the pseudonym “Jane Doe.”

Fogle’s Thursday filing also points the finger at the parents’ divorce, describing it as acrimonious. “Custody and parenting time (agreements),” it says, “required Jane Doe to constantly rotate her living arrangements caused unnecessary stress, anxiety, and trauma for Jane Doe.”

The victim’s lawsuit, which seeks at least $300,000 in damages, names Fogle and the former head of his anti-obesity charity, Russell Taylor. Taylor’s wife is also a defendant in the suit.

Prosecutors who charged Fogle and Taylor last year said Taylor used cameras hidden in the Indianapolis-area homes where he lived to secretly film 12 minors and shared some of the images with Fogle. The pornography was produced over a four-year period.

Fogle encouraged Taylor to continue filming children, who were recorded as they were nude, changing clothes or engaged in other activities while visiting Taylor’s homes, prosecutors said.

The Indiana girl suing was among those filmed and has suffered “significant emotional trauma,” her attorney M. Michael Stephenson said around the time the suit was filed.

The girl’s attorneys didn’t immediately respond to an after-hours inquiry from The Associated Press seeking comment on the latest filing.

CORPUS CHRISTI (AP) — A Texas woman must serve 30 years in prison for a babysitting scam in which she recorded her convicted sex offender boyfriend abusing a toddler in their care.

Rosa Linda Ganceres was sentenced Monday to the maximum term by a federal judge in Corpus Christi. The 54-year-old Mathis woman in June pleaded guilty to production of child pornography.

Investigators say Ganceres and her boyfriend, 43-year-old Daniel Benson Billman Jr. of Aransas Pass, advertised online in 2015 as babysitters. Prosecutors say a woman hired the pair to watch her daughter, then Billman sexually assaulted the girl and Ganceres recorded the abuse.

Billman earlier this year pleaded guilty to production of child pornography and was sentenced to 50 years in prison.

CONROE, Texas (AP) — Montgomery County authorities say they’ve arrested 36 people in an undercover operation aimed at people trying to contact children online for sex.

Prosecutors say the suspects used the internet to contact who they believed were children and arranged to meet them. When the suspects showed up, they were arrested.

The sting operation, called “Operation Safe Holiday,” began in October in the county directly north of Houston.

Some of the people arrested also have been charged with possession of child pornography and attempted aggravated assault of a child.

District Attorney Bret Ligon says it’s important for parents to know who their children are communicating with online because sexual predators are looking for opportunities to sexually exploit them.

Chicago Police Seek 2nd Teen In Facebook Sexual Assault Case

CHICAGO (AP) — An arrest warrant has been issued for a second teenage boy in the sexual assault of a 15-year-old Chicago girl that was streamed live on Facebook, and further arrests are expected, police said Sunday.

A day after announcing the arrest of a 14-year-old boy on sexual assault and child pornography charges, police said they were looking for a 15-year-old suspect in the March 19 attack, which investigators have said involved five or six males. Investigators didn’t specify how many others would likely be charged, but they did say one adult male was among them.

Police were careful not to release too many details of the ongoing investigation, but they did provide some that helped illustrate why Superintendent Eddie Johnson remained visibly upset as he has been since the investigation began.

Commander Brendan Deenihan said that the victim saw one of the suspects, whom she knew, on the day of the attack. She said the suspect “lured” her into the home of one of the offenders in the North Lawndale neighborhood on the city’s West Side, where she also lives.

“She was not allowed to leave and she did not consent to what occurred,” he said.

Police spokesman Anthony Guglielmi said the girl was threatened by suspects, but he would not say what those threats entailed.

Deenihan also said there were multiple cellphone videos made of the attack, not just the one streamed live on Facebook that was viewed by about 40 people — none of whom reported it.

“It disgusts me that we have people who would look at those videos and not pick up a phone and dial 911,” he said.

Deenihan declined to say if either of the teens who are already facing charges streamed the live video. But the charges against the 14-year-old — aggravated criminal sexual assault, manufacturing of child pornography and dissemination of child pornography — suggest that he shot video or took photographs of the attack, Guglielmi said.

Last month, the girl’s mother told The Associated Press that her daughter received online threats following the attack and that neighborhood kids were ringing her doorbell looking for the girl, who hasn’t returned to the neighborhood. On Sunday, Deenihan said police were investigating what he called “social media bullying” and that detectives have “executed social media search warrants” in the case.

He said the girl is traumatized and reluctant to talk about the attack, and that she’s going to need help for a long time. After the news conference, Guglielmi said city officials and the Cook County State’s Attorney’s office have relocated the girl to a “safe place,” but he declined to elaborate.
